How a no-deal Brexit would impact divorce legislation and procedure

The House of Commons Library has published a briefing paper outlining ways a no-deal Brexit could affect divorce procedures. The Commons Library raises the option of civil judicial co-operation which in family law is the legal framework that governs the interaction between different legal systems in cross-border situations, including divorce.

It also considers how the Jurisdiction and Judgments (Family) (Amendment etc) (EU Exit) Regulations 2019, SI 2019/519, will be applied in divorce proceedings after Brexit day when Brussels IIa and the Maintenance Regulation (EC) 4/2009 are revoked.
