The topic of ‘alienation’ within private law children proceedings appears to be an increasingly prominent one despite there being questions about what precisely ‘alienation’ means and whether there has in fact been any increase in the number of such cases.


Matthew Richardson considers the important practical decisions that need to be made in the early stages of what is often complex and difficult litigation. Topics covered include: whether the use of ‘alienation’ language is advisable; how to focus attention in the right place; the importance of early evidence-gathering; the involvement of the child and the appointment of guardians and experts.
