When local authorities collide re section 21 vs section 22 of the Adoption and Children Act 2002; which is the ‘designated’ local authority?

This article is to provide background as to the complexities the courts and practitioners face when there are opposing local authorities seeking to be (or not be) the designated local authority.

In terms of scope, this issue can be raised when the court are deciding upon the final decision for the placement of subject children subject to care proceedings.

Not only can this area of law be confusing when stumbled upon, often at the final hearing, but can at times involve little known considerations of the “disregard” provision.
