It is not clear why suddenly, after 27 years, some family mediators are abandoning their long-upheld commitment to the principle of voluntary participation in mediation, as suggested in Compulsory Mediation [2005] Fam Law 917. This article attempts to argue for a reaffirmation, rather than an abrogation, of commitment to the foundational principle of voluntary participation in mediation.
