Transgender youth in care proceedings Part 1

The number of gender incongruent children and young people who have been subject to care proceedings is currently unknown. Indeed, there have been very few reported public children law cases involving transgender children. Whilst the law remains the same regardless of the child’s gender identity, a gender incongruent young person may have different welfare concerns or issues that may be relevant to their safeguarding needs. Part 1 of this two-part article provides a comprehensive overview of the reported public children law cases concerning transgender/gender variant children, and identifies some key themes. Part 2, which will be published in the next issue of Family Law, explores the legal safeguards available to trans children and offers some comments on best practice on working with gender incongruent young people.
