The House of Lords held that the Children Act 1989 did not permit a court making a care order to oversee the manner in which it was implemented and this was not incompatible with the Human Rights Act 1998. Key ECHR issues including the positive obligations of the state, the meaning of 'determination' and the execution of judgments were not considered.
