Public sector pensions on divorce: the impact of McCloud

The judgment in McCloud and the subsequent fallout will impact nearly all practitioners who deal with financial remedies on divorce. It has led to the pension valuations of about 3,000,000 public sector employees being uncertain until at least 2023. This article aims to consider the judgment from a high level view, explain what the government is doing in response and how this impacts on those going through divorce before suggesting how family lawyers might wish to respond and what advice needs to be given to clients.
