In this article Caroline Croft of Coram Chambers provides a brief introduction to neurodivergence and looks at some of the issues neurodivergent children, adults and families can face when coming into contact with the family justice system, including away from court and during dispute resolution. Caroline also provides an introduction to the work and aims of Family Law Advice for the Neurodivergent Community (FLANC). This article discusses some of the risks that a failure to recognise neurodivergent needs can carry including: breaches of Article 6 and 8 rights and suboptimal outcomes for children and families. Caroline offers some practical suggestions for how to approach cases where there are issues related to neurodivergence or suspected neurodivergence, with a particular focus on the role that timely and targeted assessments and adjustments can play.
