In their article, 'Disclosure of Social Services Documents into Criminal Proceedings' October [2005] Fam Law 806, Alistair Perkins and Elizabeth Tomlinson (the authors) cast considerable doubt on the lawfulness of the national protocol between the Crown Prosecution Service (CPS), police and local authorities in the exchange of information in the investigation and prosecution of child abuse cases. They conclude that the key paragraphs of the procedure should be treated with extreme caution. It is suggested, however, by Victor Smith that the authors are being somewhat overcautious.
