Future proofing family business: an examination ‘in the round’

Prevention is almost always better than cure when it comes to dealing with family businesses on divorce or family separation.  A multi-disciplinary legal approach is often needed given the myriad of legal issues that arise from employment to succession planning, family to corporate. Illustrated through a case study based on real-life examples, the authors identify some of the common - and less-common - problems family lawyers and professional advisers can encounter and how, with some early legal advice (even before marriage let alone divorce is contemplated), the opportunity is there to avoid, mitigate and manage the fall out when the end of a relationship plunges a family business into crisis.
