Beyond the welfare principle [2002] CFLQ 237

This article examines criticisms of the 'welfare' or 'best interests' principle and considers how the law might be formulated should it ever be decided to abandon the principle. The conclusion is that such a reformulation would be difficult, but not impossible, and could be attractive.
