The Scottish Courts and Tribunals Service (SCTS) has released new simplified divorce and dissolution forms of application. As a result of legislation repealing Council Regulation EC 2201/2003, the grounds of jurisdiction for divorces and dissolutions changed with regards to applications received by courts after the end of the transitional period.
With the Act of Sederunt (Rules of the Court of Session 1994 and Sheriff Court Rules Amendment) (Miscellaneous) 2021, SSI 2021/75 coming into force on 1 March 2021, changes will be made to court rules and prescribed application forms, including to ensure that grounds of jurisdiction comply with current legislation.
The new forms for the sheriff court can be found here.
The new forms for use in the Court of Session will be made available prior to 1 March 2021
